Albuquerque, N.M. – The city of Albuquerque recently settled a lawsuit regarding a hazardous intersection, resulting in significant payouts and safety enhancements.
Lawsuit Settlement and Payout
In March 2019, Corey Hall sustained a permanent brain injury in a collision at 98th and Volcano. Represented by John Sloan, Hall sued the city and other parties, asserting that the intersection’s danger escalated with increasing development and traffic. The lawsuit highlighted a rising trend in crashes from 2015 to 2018.
Four years later, the city settled the suit for $750,000, citing statutory caps governing governmental entity lawsuits. John Sloan expressed satisfaction with the outcome, noting the exhaustion of the cap.
City’s Response and Safety Measures
Beyond financial compensation, the city took proactive steps. Following the lawsuit, the Traffic Engineering Division examined the intersection, identifying west-to-south left-turning cars as a common factor in many crashes.
In July 2022, the city installed yellow barriers to deter these turns. This initiative showcased Albuquerque’s commitment to addressing safety concerns promptly. The impact of these measures was tangible. According to the Department of Municipal Development (DMD), there were 27 potentially preventable crashes from March 2019 to March 2020. However, since the barrier’s installation, there have been no reported correctible crashes at the intersection.
