An Arizona rancher, George Alan Kelly, 75, is on trial for the fatal shooting of a migrant on his property near the Mexico border. The trial, taking place in Santa Cruz County Superior Court, is expected to last up to a month.

Kelly rejected a plea deal that would have reduced the charge to one count of negligent homicide. He faces charges of second-degree murder in the shooting of 48-year-old Gabriel Cuen-Buitimea of adjacent Nogales, Mexico.

Kelly encountered a group of unarmed migrants on his nearly 170-acre cattle ranch in the Kino Springs area and fired an AK-47 rifle toward them, according to authorities. Cuen-Buitimea was among the group, and prosecutors argue that Kelly recklessly endangered their lives.

Kelly’s defense attorney contends that he shot into the air above the migrants out of fear for his safety, as well as that of his wife and property. The other migrants escaped back to Mexico unharmed.

Cuen-Buitimea had a history of illegal entry into the U.S., with court records showing multiple convictions and deportations, most recently in 2016.

The shooting has reignited debates over border security, particularly in light of recent similar incidents. Less than six months prior, twin brothers Michael and Mark Sheppard were arrested in a West Texas shooting that killed one migrant and wounded another.

The Sheppard brothers were charged with manslaughter after opening fire on a group of migrants near the border, highlighting the tensions surrounding immigration enforcement.

Border security has become a central issue in the ongoing presidential contest, with both Republican Donald Trump and Democratic President Joe Biden making visits to the Texas-Mexico border in late February 2024.
