In Cupertino, California, a former candidate for Santa Clara County Sheriff, Anh Colton, 51, has been convicted of felony perjury for falsely claiming to have the necessary law enforcement experience, announced the District Attorney’s Office.
According to California law, candidates for sheriff must possess at least one year of law enforcement experience within the last five years or hold a certificate demonstrating advanced training in law enforcement. Colton failed to meet either requirement.
Lack of Experience Unveiled
Questions regarding Colton’s qualifications arose following her participation in a candidate forum organized by the Silicon Valley Public Accountability Foundation in late March.
Subsequently, the District Attorney’s Office dispatched an investigator to Colton’s residence in April. However, Colton directed the DA to her campaign advisor, who advised the office to refrain from contacting the candidate. Colton remained unresponsive to requests for comment from media outlets such as the San Jose Spotlight.
Legal Ramifications and Election Impact
Despite her false claims, Colton’s name appeared on the primary ballot and garnered over 4% of the vote. However, this share was insufficient to significantly affect the election outcome.
District Attorney Jeff Rosen emphasized the gravity of perjury in election matters, stating that such deceit could potentially obstruct legitimate candidates from progressing to runoffs or secure outright victory.
Following the verdict, Colton was sentenced to the duration she had already served in jail, totaling 134 days.
Investigation Timeline and Election Outcome
The District Attorney’s Bureau of Investigations initiated scrutiny into Colton’s qualifications before the 2022 primary election. However, conclusive findings were not reached until after ballots featuring her name had been distributed.
In the absence of the longstanding sheriff, Laurie Smith, who opted not to seek reelection for a seventh term, Bob Jonsen emerged victorious in the sheriff’s race on June 7, 2022.
