Las Vegas, Nev. – An investigation conducted by the U.S. Department of Labor has uncovered instances of unpaid overtime at three La Mojarra Loca restaurant locations in Las Vegas.

Violations Uncovered

The investigation revealed that the restaurants, situated on Maryland Parkway, Lamb Boulevard, and Lake Mead Boulevard, failed to compensate employees for overtime hours worked, contravening the Fair Labor Standards Act. Additionally, employees were improperly classified as exempt from overtime pay, receiving a fixed salary regardless of the hours worked.

Repeat Offenses

This isn’t the first time La Mojarra Loca has faced such allegations. Similar infractions were discovered at some of their locations in 2019 and again in 2022, indicating a pattern of non-compliance.

Financial Impact

The repercussions of these violations are significant. Over $75,729 in owed overtime wages were withheld from 33 employees, but have since been recovered by the Department of Labor. Furthermore, the employer incurred civil money penalties totaling $9,058 due to the repeated and reckless nature of the violations.

Ongoing Enforcement Efforts

District Director Gene Ramos of the Wage and Hour Division in Las Vegas expressed determination to combat such practices, stating, We are determined to do everything in our power under the law to stop the unacceptable practices of employers such as La Mojarra Loca.

Previous Cases

Previous investigations into La Mojarra Loca establishments have resulted in the recovery of approximately $450,000 in unpaid wages for affected employees, along with penalties amounting to up to $34,000.
