Porterville, Calif. – Elizabeth Nungaray, a 47-year-old from San Jose, was sentenced to life in prison for the DUI deaths of two individuals and causing significant injuries to others in a tragic accident.
Fatal Collision at Main Street and Orange Avenue
The incident occurred when Nungaray ran a red light at the intersection of Main Street and Orange Avenue in Porterville on June 19, 2021. Her vehicle collided with a van carrying an aunt, a mother, and four children aged between 5 and 13 years old. The collision resulted in the death of a 10-year-old girl at the scene, and an 8-year-old sister later succumbed to injuries at the hospital.
Tragic Aftermath
The surviving family members sustained severe injuries, including permanent paralysis, while the occupant of a third vehicle involved suffered minor injuries. Nungaray’s reckless behavior, which included speeding, swerving, and disregarding traffic signals, led to this devastating outcome. It was revealed that her blood alcohol level was .15%, well above the legal limit.
Previous Conviction and Legal Consequences
Nungaray had a prior DUI conviction from 2000, making this incident even more egregious. In March, she pleaded no contest to two counts of second-degree murder and one felony count of DUI causing injury. The charges were further compounded by special allegations due to her previous felony convictions and the significant bodily harm inflicted.
Minimum Parole Eligibility
Under California state sentencing laws, Nungaray faces a minimum parole eligibility of 30 years, not including credits from the California Department of Corrections and Rehabilitation (CDCR). This severe sentence underscores the gravity of her actions and the devastating impact they had on multiple lives.
Conclusion: Justice Served
The sentencing of Elizabeth Nungaray brings a semblance of closure to the affected families, albeit unable to fully compensate for their profound loss and suffering. This tragic incident serves as a stark reminder of the consequences of driving under the influence and the importance of responsible behavior on the roadways.
